版权保护强度与广播电视产业绩效间的关系研究——基于中国省际面板数据的实证分析

A Study on the Relationship Between Copyright Protection and Radio and Television Industry Performance: An Empirical Research Based on China’s Province-level Panel Data

摘要

本文以2008-2019年中国各省市的版权保护和广播电视产业相关数据为研究样本,采用计量经济学方法深入分析版权保护强度与广播电视产业绩效之间的关系以及这种关系背后的内在机理。研究发现,在全国范围内,就广播电视产业经济收入而言,版权保护强度对其的影响呈现“U型”关系,即当版权保护强度低于一定临界点时表现为负面影响,超过一定临界点时则表现为正面促进作用;就广播电视节目制作时长而言,版权保护强度无论是对广播电视机构还是对广播电视从业者的生产积极性均提升有限,导致其对广播电视节目制作时长并未呈现显著性影响。在不同区域下,经济发达地区版权保护强度对广播电视产业经济收入具有“U型”影响,但对广播电视节目制作时长却呈现倒“U型”影响;经济欠发达地区版权保护强度对广播电视产业经济收入和广播电视节目制作时长则无显著性影响。

Abstract

This paper employs an econometric approach with panel data of different provinces in China from 2008 to 2019 to explore the relationship between copyright protection and radio and television industry performance, and analyze the underlying mechanism of this relationship. Results find that, for the entire country, copyright protection’s effect on radio and television industry income is U-shaped. When less than the critical point, copyright protection has a negative effect; while higher than the critical point, it has a positive effect. For radio and television production time, copyright protection has no significant effect on the production motivation of radio and television organizations and their workers, causing it has little impact on radio and television production time. In terms of different regions, copyright protection has a U-shaped effect on radio and television industry income and an inverted U-shaped effect on production time in developed area, while having little effect in developing area.

This article analyses China's recent attempts to counter “local protectionism” and establish standardization in policy implementation and enforcement by centralizing a growing number of its regulatory bureaucracies up to the provincial level (what I refer to as “soft” centralization). In this article, I argue that Beijing's experiment with soft centralization, while successful to some extent, has nevertheless fallen short of its goals and that thus far this transformation remains imperfect and incomplete. The institutional cleavages and fragmentation that so often give rise to corruption and other pathologies of the state appear to have shifted from horizontal, geographic lines to vertical, functional ones. Moreover, the principal beneficiaries of this shift to centralized management are the provinces, not Beijing, as the institutional mechanisms of personnel and budgetary resource allocations are concentrated at the provincial level. Although this has curbed localism to a degree by transferring power from local governments to the newly centralized bureaucracies, it has also contributed to a situation in which newly strengthened provinces may play a key role in the emergence of a sort of perverse federalism.

Digitization has impacted firm profitability in many media industries by lowering the cost of copying and sharing creative works. I examine the impact of digital rights management (DRM), a prevalent strategy used by firms in media industries to address piracy concerns, on music sales. I exploit a natural experiment, where different labels remove DRM from their entire catalogue of music at different times, to examine whether relaxing an album’s sharing restrictions increases sales. Using a large sample of albums from all four major record labels, I find that removing DRM increases digital music sales by 10%, but relaxing sharing restrictions does not impact all albums equally. It increases the sales of lower-selling albums (i.e., the “long tail”) significantly (40%) but does not benefit top-selling albums. These results suggest that reducing search costs facilitates the discovery of niche products.

2. 因国家版权局2009-2019年披露的行政机关查处案件和收缴盗版品数量为全国数据、未披露各省市相关数据,本文对各省市相应数据则基于以下两个步骤获得:首先根据2000-2008年全国各省市行政机关查处案件和收缴盗版品数量,采用自回归移动平均模型获得各省市2009-2019年的初步预测值;其次将全国各省市2009-2019年的初步预测值进行求和,并按照求和值占相应年份全国实际总值的比例对初步预测值进行统一换算。

4. 这一点与美国版权实践类似,美国在建国后相当一段时间内采取的是本土版权保护策略,即只保护美国本国公民版权,并不保护外国文化作品版权,以便借鉴外国文化作品;直到二战后伴随着美国文化产业的快速发展,美国开始成为文化产品出口大国,为保护美国文化产品的海外出口利益,美国开始于1955年加入《世界版权公约》,并开始向世界各国推行较强版权保护(张南,2019)。
