1922年《出版法》和1981年《媒体法》是20世纪奥地利历史上两部针对大众传媒颁 布的专门法。但如果从人格权制度来审视这两部法律,我们会发现1922年的《出版法》 几乎不涉及人格权制度,而1981的《媒体法》专设章节规定此项内容。本文分析了1922 年的《出版法》不涉及人格权制度的成因,从人格权制度的两个角度分析1981年的《媒 体法》对于此项制度的详细规定以及如何与《民法典》、《刑法典》联动。在此基础 上,笔者试图分析《媒体法》引入人格权制度的历史动因,特别强调了《欧洲人权公 约》 的影响。

The Press Act of 1922 and the Media Act of 1981 are two special laws on mass media in the 20th century Austrian history. If analyzing these two laws from the system of personality right, we’ll find that the 1922 Press Act hardly touched the personality right. On the contrary, the Media Act of 1981 established many detailed provisions concerning the personality right. This study interprets the reason why the 1922 Press Act didn’t involve the right of personality, and also analyzes personality tort defense and legal relief in the Media Act of 1981 and the link among the Media Act, the Civil Code and the Criminal Code. Pursuant to the above discussion, the study attempts to analyze the historical agents of incorporating the system of personality right into the Media Act, particularly emphasizing the influence of the European Convention on Human Rights.
